Accused of kidnapping a minor, man makes bail after months on remand
A 38-year-old man, on remand since July for the rape and kidnapping of a minor, was granted $10 000 bail yesterday.
Sergeo Olivia Payne, of Upper Wavell Avenue, Black Rock, St Michael was able to leave the District 'A' Magistrates' Court via the exit gate instead of heading to the prison bus once again for a return trip to HMP Dodds.
Back on July 23, Payne had pleaded for leniency in relation to the allegations that he removed the young girl from her home and had sexual intercourse with her without her consent on April 5.
He is also accused of stealing a $250 cellular phone and a $290 haversack on April 18 belonging to the same person. A charge he denies.
Despite telling the court that he was "set up" and could not afford to go to jail for the sake of his children, he was remanded. The prosecution objected to his bail at that time as well. It was argued that Payne had a concerning history and evidence showed "he used intimidation, coerced and demanded from the victim responses she is unable to consent to".
Payne is not required to plead to the rape and kidnapping charges at the Lower Court. He returns to court on March 5, 2019, and must stay away from the complainant.
